After three years of debate on the nature of civil society reflecting anemic, only now, with the acquisition of constitutional basis at the level of the Presidency, enter the beginning standard algorithm
On the one hand, we are trying a sense of enjoyment. Center for Institutional analysis and Development (CADI), an organization brings representatives of the current, classical liberal and libertarian ordoliberal in Romania, was among the first public entities who proposed the topic on the agenda. Launch them successfully in 2006, imposing them as central theme within the structure of the annual Conference of think tanks free market in Europe in 2007 and the group a Constitution for freedom last year signals all interest in the constitutional process and, at the same time, engaging in a social project of the next generation of liberal and libertarian.
On the other hand, start the process at the level of the constitutional State institutions is a cause for fear. Because, being aware of the huge disparity between the State and civil society, is possible at any time as the result of metamorphosis to be a etatizare and more. Generally, the finer adjustments to the level of fundamental institutional layers are able to produce major changes and unintended individuals in all matters of life. It also remains to be seen, in the current situation, to what extent the power of the State will deviate from the terms in which a wanted us serviceman.
We know, however, in the spirit of the theory of James Buchanan, father constitutionalismului classic liberal revival in the twentieth century, as the constitutional process, in terms of negotiating the rules of the game never ends, just as it has no beginning. While the dice are playing now, we support the principles and arguments to use an upcoming civil society, a large crowd of actors anonymous, diffuse and mature enough to establish and maintain a real liberal Constitution. Here, the arguments are all that matter. What we do is, in essence, to support the positions of principle. We are aware that any discussion technique, in the absence of guiding principles, it will stuck sooner or later. We aim to constantly relive the Liberal and libertarian perspectives, always remembering what is at stake, beyond the political contexts of the moment and purely technical aspects.
In the 13 articles of the following pages the authors consider the principles that have relevance for both time horizons: the far East and that of the political game and entrepreneurship of the here and now.
For the reader to this horizon are two useful things. On the one hand, diagnosis of problems-formulations biased opinionated, imbalances between the functions of the State, ambiguity and contradictions that inevitably work in the service of the authorities-and on the other proposals for public policies applicable in relatively easy matters publicized, as well as administrative decentralization, ordinances, emergency control over the intelligence services.
The reader prepared for a broader horizon will rejoice to find radical reform: principles of free competition in the provision of public services, privatization of the nation's currency, date, as well as non-governmental structures, Churches, to conclude contracts and earmark dispute, eliminating any constitutional exemption in the field of freedom of expression, the selection by drawing of lots of the members of the Superior Council of Magistracy, the permission of the legislative mechanisms eludeaza alternative legislative authority. No matter how outlandish, the solutions are but developments of the classical liberal tradition, another exotic ground landing.
