Intro:
Hart holds that moral rights exist if there is at least a natural law: the equal right of all people to be free. This right has two characteristics: 1. We have all the people who are able to choose; 2. is not conferred or created by voluntary action of the people. The argument starts from the legal distinctions between the rights, freedoms and obligations. Materialises as having a right is to have a moral justification to limit the freedom of another person. This moral justification can be: a) a special type that derives from special transactions between individuals as well as promises, authorizations and mutual restriction (political rights) plus family relations and special permissions and b) of the general type which can be reduced to the principle of equality of all people to be free in the absence of any special conditions to limit the freedom of someone else.
