Analysis of the vulnerabilities of the judiciary. Solutions and proposals for modernization
This document was developed within a project of the Center for analysis and institutional development — Eleutheria, in partnership with the Konrad Adenauer Stiftung-Rule of Law Program South East Europe, entitled "Drafting of long-term reform strategy for the Romanian justice system", defasurat from April to December 2010.
The project idea was born from a double finding. On the one hand, over the past 20 years, most of the time, strategic vision regarding justice was crystallized in the short term or medium. On the other hand, after joining the EU, it has not been a unique strategy for Justice, with the various strategic documents of the various institutions and authorities involved in the functioning of the system.
As such, the project, based on an inventory of current problems and weaknesses, proposing an exercise of imagination, trying to answer the question: "How do we want to work for Justice in 2020?"
The project is under the sign of diversity-diversity both in terms of the areas analysed in terms of specialization of its authors. Thus, addressed areas such as legislative and institutional instability, the fight against corruption, the recruitment, training and career magistrates, and functioning of the constitutional or Supreme Council of Magistracy, the competence of the present and future of the High Court of Cassation and justice, effective procedures, access to justice and the relationship with the press. The analysis does not controversial topics or dodges the strict topicality: who should manage the budget for Justice?, how should accomplish a promotion to the High Court?, how can I ensure a just balance between independence and accountability, who and how should we measure the quality of Justice as a public service?
The perspective provides this analysis of diverse areas is mentioned as one of the experts who have contributed to the seminar: magistrates at various levels of jurisdiction, lawyers, University professors, civil society representatives or officials of the European Court of human rights.
